User Agreement

The rights to use the Services of Creafile.com
Our Services are given physical and legal persons. Accepting this Agreement, the User confirms the fact that he reaches the age of 18 and has the right to conclude the contracts, which have a binding force, as the Client.
Services of Creafile.com
The client, user (or You) means a physical or legal person, that uses or intends to use the Services;
Services of Creafile.com mean the electronic or interactive services given by Creafile.com.
Creafile.com reserves the right to change or stop all of Services at any time.
Ownership of information and copyrights.
You agree that all materials, submitted on the present Web page (except the users' uploading), belong to Creafile.com.
The information about the Client.
The client undertakes to give Creafile.com the true, exact and complete information about him or herself for all of the questions that are offered in the registration form.The client agrees opportunely to update and support the information in true, exact and complete state.The client agrees to receive the news of service, information about new services and actions organized by Service Creafile.com on the e-mail address. If you give the incorrect, inexact, outdated or incomplete information, Creafile.com has the right to stop or cancel your registration and this Agreement.
Responsibility for access.
The client agrees that voluntary transfer of login and password of its privileged account (VIP - account) to third parties leads to automatic cancellation of privileged status of the account, and states the fact about violation of this user's agreement by client.
Responsibility for identification of users and passwords.
The user is completely responsible for saving of confidentiality of the information of access to his or her account (login and password), and also has complete responsibility for the actions made in his or her account.
The notice about unauthorized use.
The authorized user undertakes to notify Creafile.com immediately in case of occurrence of the circumstances indicating that his or her account or information has been used unauthorized.
Client's data.
The user has exclusive obligations and complete responsibility for the information which he or she saved on the servers of Creafile.com. The client supervises the own information through the unique link generated for him or her. Creafile.com will delete the client's information after expiration of this Agreement.Creafile.com reserves the right to keep the user's information in the archives after its removal, and in any case does not incur obligations to the user for such information.
Permissible usage.
You agree not to use the Service of Creafile.com for the purpose of:
1. File loading with information contents, which spread the terrorist propagation, propagandizing of kindling interethnic, racial or religious break a set, representing violence or death; if we consider the same content sufficiently serious, it will be transferred to appropriate body of law and order and/or members of ISP;
2. Damnification to minors in any form, including any form of a child pornography; if we consider the same content sufficiently serious, it will be transferred to appropriate body of law and order and/or members of ISP;
3. File loading with information contents, which encroach on another's rights of any patent, trademark,commercial secrets, copyrights or other property rights;
3.1 Illegality. The contents for adults. Creafile.com doesn't authorize and allow the sites containing illegal materials, and also other forms of transmission of illegal or obscene materials and information prompting illegal actions including gaming, illegal sales of weapons, advertising or publication of materials, which can break the corpus of legislations about sexism and racism.
3.2 Creafile.com reserves the right immediately to suspend or stop, without the preliminary prevention, your registration or transaction violating the present agreement..
3.3 Criminal behaviour.
The client undertake not to make or admit criminal or destructive acts, also including the publication of discrediting, scandalous private information concerning any person, without the consent or intentionally morally to damage someone.
3.4 Access and intervention.
Intrusions or attempts of intrusion in the information system of Creafile.com, or attempts to affect the ability of Creafile.com to render Services, are strictly prohibited and are the subject of criminal and a civil liability.
3.5 Infraction of the law about intellectual property and trademarks.
Services of Creafile.com can be used exclusively in the lawful purposes. Transfer, distribution and storage of materials, violating applicable laws or decisions including laws about export regulation, are forbidden.
3.6 Abuse of system resources.
The client undertakes not to abuse system resources of Creafile.com that also includes usage of informational content, occupying excessive memory size CPU or influencing on capacity of our system; resale of access to the informational content, placed on servers Creafile.com.
Other activity.
Lawfully or not, Creafile.com reserves the right to decide what is pernicious for activity or reputation of Clients that includes any operation limiting or precluding other users to utilize the Services or Internet. Please, pay attention, in case if it’s detected that an account or transmitted information breaks any of those rules, Creafile.com reserves the right to delete the account or stop the transfer of information. If it’s necessary, Creafile.com will send complaints to corresponding legal structures. In this case, Creafile.com will actively cooperate with law and order bodies in investigation and criminal prosecution of similar actions that means the disclosure of the data of Client’s account.
Complaints on the persons, breaking our Rules, are accepted by e-mail abuse@creafile.com. Each complaint will be considered and depending on the results can lead to the deletion of Client’s account without preliminary prevention.
Absence of guarantees.
You express understanding and agreement with the following:
1. You use these services at your own risk.
Services of Creafile.com are given “as is” and “as far as possible”. Creafile.com and its representatives, allowed by the legislation, relieve their of all responsibility for the any guarantees, including the guarantee of a legal title, conformity of the user’s purpose, guarantee of commercial validity and guarantee of absence of infringement of third parties  rights. Creafile.com and its representatives don’t guarantee accuracy, reliability, completeness, timeliness of Services, software or information content;
2. Creafile.com doesn’t guarantee that:
- Services will correspond to your requirements,
- Services will be given continuously, quickly, reliably and without mistakes,
- Results, which can be received at usage of services, will be exact and reliable,
-Quality of some product, service, information or other materials, which you received through the utilization of Services, will correspond to your expectations,
3. Risks.
Some materials, which you  loaded or otherwise received through the utilization of Services, are used by you at your own discretion and risk and you have exclusive responsibility for any loss of data and any other damage which can damage your computer system or as a result of loading of these materials;
4. Guarantees.
Any consultation or information, written or oral, received by you by the instrumentality of Services, doesn’t represent a guarantee, except direct guarantees which are given in the present Agreement.
5. Acquittance of responsibility.
You agree to indemnify, including reasonably necessary payment of legal services, and to release Creafile.com, its filial organizations and branches, management, employees, agents from responsibility for any claims and requirements for the reason of your usage of Services; or violation of the present Agreement by you or other rules, decisions and conditions of Creafile.com.
6. Responsibility limitation.
You use the services of Creafile.com at your own risk. If you aren’t satisfied with our Services or present user agreement, or some other rules, you have the right to stop usage of Services. You agree that Creafile.com isn’t responsible for any direct, indirect, collateral or penal losses, including losses of lucrum cessans, loss of reputation, loss of data or other non-material losses (even if we have received the warning about possibility of such losses), taken place for reasons:
- Use or impossibility of use of services;
- Necessities anew to pay the unsuitable goods or services, purchased through the utilization of services;
- Unauthorized access or modification in transmitted information or data;
- Statements or actions of any third party within the limits of services;
- Any other event concerning Services.
7. Modification of the Agreements and Rules for extension of Services.
We reserve the right to change the present agreement for extension of services at any time. We also reserve the right at any time to modify or stop Services with the prior notification or without it, for certain period or termless. You agree that Creafile.com doesn’t incur obligations to you, to any third party for any modification, suspension or termination of Services.You recognize that we can establish the general rules and limitations of using Services, including the maximum size of disk space allotted to you on servers of Creafile.com, maximum number of calls (and their maximum duration) to Services for the certain period of time. Also, you recognize that Creafile.com has the right without the preliminary prevention to change tariffs for using of Services. Modification of tariffs for using of Services comes into force after the termination of validity of Client’s existing subscription.
8. Termination of registration.
Creafile.com doesn’t stint itself in the right immediately to prevent, suspend, (without a time limit or temporarily) to close access and to stop assignment of Services to the client, or to delete the account of the Client, and also to refuse assignment of Services to the client further in case of:
- Creafile.com is justified to believe that the Client has broken or hasn’t executed any aspect of the present Agreement or other contracts or instructions of Creafile.com,
- Client hasn't paid for services or any others indebtednesses to Creafile.com,
-Creafile.com cannot establish authenticity of the information given by the Client,
-Creafile.com is justified to believe that actions of the Client can entail legal responsibility of the Client, other clients of Creafile.com or Creafile.com.
-Creafile.com reserves the right at their own discretion at any time to stop Services or their part, with the prior notification or without such.  You agree that the termination of access to Services in any item of present  user's agreement can inure without the prior notification, and also agree that Creafile.com has the right immediately to deactivate, archive or delete your account and all information concerning it, the data and-or refuse the further access to those data or Services. In addition you agree that Creafile.com isn’t responsible to you or any third party for the termination of your access to Services.

After the cancellation of the present Agreement by the Client or Creafile.com, all privileges of the Client stipulated in the Agreement, and obligations of Creafile.com in extension of Services, are immediately cancelled.
Features after cancellation.
Paragraphs: « Client's data », «Absence of guarantees», «Acquittance of responsibility», « Responsibility limitation» and « Modification of the Agreements and Rules for extension of Services» will be in force after cancellation of Agreement.
General information
1. Legal relationship
The client and Creafile.com are independent contractors. The present Agreement doesn’t provide and create such forms of legal relationship with the Client as establishment, company, joint venture, labour relations, trading relations.
2. Cession of rights.
By the terms of the present Agreement the Client has no right to transfer any rights or to assign other persons the duties. Any attempts of cession of rights will not have validity.
3. Vis major.
Our activity for the extension of services can be broken by various, uncontrollable factors.  We don’t have the responsibility for any delays, or inability to render Services as a result of reasons, which don’t depend on us.
4. Interpretation.
If any disposition of the present Agreement is invalidated, this disposition should be bypassed with the least damage of interests of the parties, and other dispositions of the Agreement continue to operate in full. Captions of items of the Agreement serve only for convenience, and in any degree don’t define, limit, interpret or describe the spectrum or measure of item of the Agreement.
5. Confidentiality of Information Creafile.com.
You declare and guarantee to company Creafile.com the following:
- You aren’t a competitor of Creafile.com;
- You undertake not to divulge information and not to do available the materials concerning to preparing for receipt in sale to the software, trials and test methods;
- You undertake not to use the information received through the utilization of the website of Creafile.com, and Services of Creafile.com for being in a competition to the last.
